1. 1. Contract-Based
Relationship
Terms of Use
("Terms")
These Terms
outline the conditions under which you, as an individual, may access or use the
applications, websites, content, products, and services ("Services")
provided by Zebo Ride (operated by Taha), a private limited liability company
registered in India. The company’s registered office is located at [Taha
Address], with a place of business at [Bihar Address] and additional offices in
other states. Its Corporate Identification Number (CIN) is 0000000000.
Before
accessing or using the services, please review these terms carefully.
By accessing or using the Services, you agree to these Terms, forming a
binding contract between you and Zebo Ride. If you do not accept these Terms,
you are not permitted to use the Services. These Terms replace any previous
agreements you may have had with Zebo Ride.
Zebo Ride reserves the right to terminate these Terms or your access to
the Services at any time, for any reason, without notice. Additional terms may
apply to specific Services (e.g., promotions, events, or activities), and these
will be provided to you when relevant. Such supplemental terms are considered
part of these Terms and will take precedence in case of any conflict.
Zebo Ride may update these Terms periodically, with changes becoming
effective once posted. Your continued use of the Services after such updates
constitutes acceptance of the revised Terms.
Zebo Ride’s Privacy Policy (available at https://linkofprivacypolicy) outlines how
personal information is collected and used. In the event of a complaint,
dispute, or incident involving you and a Third Party Provider (e.g., a
rideshare driver), Zebo Ride may share necessary information (including your
contact details) with insurers or claims processors to resolve the matter.
1. 2. The provided
services
The Services include:
(a) A technology platform that allows users of Zebo Ride’s mobile apps or
websites (each, an "Application") to book transportation and/or
logistics services provided by independent third-party providers (such as
drivers or delivery partners) contracted with Zebo Ride or its affiliates
("Third-Party Providers").
(b) User
support services, such as payment processing, trip details sharing, issue
resolution (including complaints and support tickets), airport or location
pickup arrangements, and other related assistance.
(c) A
"Ride Coupon" feature, which offers users discounted rides as periodically
provided by Zebo Ride.
Unless Zebo
Ride has a separate written agreement with you, these Services are intended
only for personal, non-commercial use.
YOU UNDERSTAND THAT ZEBO RIDE IS NOT A
TRANSPORTATION OR LOGISTICS SERVICE PROVIDER, NOR DOES IT OPERATE AS A
TRANSPORTATION CARRIER. ALL SUCH SERVICES ARE DELIVERED BY INDEPENDENT
THIRD-PARTY CONTRACTORS WHO ARE NOT EMPLOYED BY ZEBO RIDE OR ITS
AFFILIATES."
LICENSE.
As long as you follow these Terms, Zebo Ride
grants you a limited, non-exclusive, non-sublicensable, revocable, and
non-transferable license to: (i) access and use the Applications on your
personal device only for the purpose of using the Services; and (ii) access and
use any content, information, or related materials provided through the
Services—strictly for personal, noncommercial purposes. All rights not
explicitly granted here are reserved by Zebo Ride and its licensors.
LIMITATIONS.
Prohibited Actions: You are not allowed to:
SERVICE
PROVISION.
You recognize
that certain parts of the Services may be offered under Zebo Ride’s different
brands or request options related to transportation or logistics. These
currently include transportation services labeled as “(Service name for Sedan)”
and “(Service name for Hatchback),” as well as logistics services referred to
as “(Service name for Logistics).” Additionally, you understand that these
Services may be provided under such brands or request options either: (i) by
Zebo Ride’s subsidiaries and affiliates; or (ii) through independent
Third-Party Providers, such as drivers affiliated with transportation network
companies, holders of transportation charter permits, or individuals with
similar transportation authorizations or licenses.
THIRD PARTY SERVICES AND CONTENT.
Third-Party Services and Content
The Services may be accessed or used alongside third-party services and content
(including advertisements) that are not controlled by Zebo Ride. You agree that
such third-party services and content may be governed by separate terms and
privacy policies. Zebo Ride does not endorse these third-party offerings and
assumes no liability for their products or services.
If you access the Services through apps designed for
Apple iOS, Android, Microsoft Windows, or BlackBerry devices, Apple Inc.,
Google Inc., Microsoft Corporation, BlackBerry Limited, and/or their
international subsidiaries and affiliates will be considered third-party
beneficiaries of this agreement. These beneficiaries are not parties to this
contract and bear no responsibility for providing or supporting the Services.
Your use of the Services on such devices is subject to the terms outlined in
the respective third-party beneficiary’s terms of service.
Ownership
The Services and all associated rights remain the exclusive property of Zebo
Ride or its licensors. These Terms do not grant you any rights beyond the
limited license specified earlier. You may not use or reference Zebo Ride’s (or
its licensors') company names, logos, trademarks, service marks, or product and
service names without explicit permission.
YOUR ACCESS AND USE OF
THE SERVICES
USER ACCOUNTS.
To access most features of the Services, you
need to create and keep an active personal user account ("Account").
You must be at least 18 years old—or the legal age of majority in your region
if it differs—to open an Account. During registration, you’ll need to provide
Zebo Ride with personal details such as your name, address, mobile number, and
age, along with at least one valid payment method (either a credit card or an
approved payment partner). You must ensure that your Account information
remains accurate, complete, and current. If your Account details are outdated
or incomplete—including having an invalid or expired payment method—you may
lose access to the Services, or Zebo Ride may terminate these Terms with you.
You are accountable for all actions taken under your Account and must keep your
login credentials secure at all times. Unless Zebo Ride explicitly allows it in
writing, you may only have one Account.
USER NEEDS AND CONDUCT.
Usage Restrictions:
The Service is restricted to individuals aged 18 or older. You are prohibited
from allowing third parties to access your Account or permitting minors under
18 to receive transportation or logistics services from Third Party Providers
unless you accompany them. Additionally, you may not transfer or assign your Account
to another person or entity.
Legal Compliance & Conduct:
When using the Services, you must adhere to all applicable laws and use them
only for lawful purposes—such as refraining from transporting illegal or
hazardous materials. Your use of the Services must not cause nuisance,
inconvenience, property damage, or annoyance to Third Party Providers or
others.
Identity Verification:
In some cases, you may be required to verify your identity to access or use the
Services. Failure to provide valid proof of identity may result in denied
access.
SMS (Short Message Service)
When you create an Account, you consent to
receiving informational SMS messages as part of Zebo Ride’s standard
operations. If you wish to stop receiving these messages, you can opt out at any
time by emailing support@zeboride.com with
your request and the mobile number receiving the texts. Please note that opting
out may affect your experience with the Services.
PROMO CODES POLICY.
Zebo Ride reserves the right, at its sole
discretion, to issue promotional codes ("Promo Codes") that can be
redeemed for Account credit, Services-related benefits, or Third-Party Provider
perks, subject to any additional terms set by Zebo Ride.
By using Promo Codes, you agree to the
following:
Proper Use – Promo Codes must be used lawfully, only for their intended
purpose and audience.
No Unauthorized Distribution – They cannot be duplicated, sold, transferred, or publicly shared
(including on public forums) unless Zebo Ride explicitly permits it.
Modification & Disabling – Zebo Ride may deactivate Promo Codes at any time without
liability.
Compliance with Terms – Each Promo Code must be used in accordance with its specific
terms.
No Cash Value – Promo Codes cannot be exchanged for cash.
Expiration – They may expire before use at Zebo Ride’s discretion.
Zebo Ride also reserves the right to
revoke or adjust credits or benefits obtained through Promo Codes if it
suspects misuse, fraud, violation of terms, or any unauthorized or erroneous
redemption.
CONTENT PROVIDED BY THE USER.
User Content Submission and License
Zebo Ride may, at its sole discretion,
allow you to submit, upload, publish, or otherwise provide content—including
text, audio, and visual materials—through its Services. This may include
feedback, support requests, contest entries, or promotional submissions
(collectively, “User Content”).
While you retain ownership of your User
Content, by submitting it to Zebo Ride, you grant the company a worldwide,
perpetual, irrevocable, transferable, royalty-free license (with the right to
sublicense) to use, modify, distribute, publicly display, publicly perform, and
create derivative works from your User Content in any format or channel, now or
in the future. This includes use in connection with Zebo Ride’s Services,
business operations, and third-party platforms, without further notice,
consent, or compensation to you or others.
By providing User Content, you confirm
that:
You either own all rights to the User
Content or have the necessary permissions to grant Zebo Ride the above license.
Your submission and Zebo Ride’s use of the
User Content will not violate any third-party rights (including intellectual
property, privacy, or publicity rights) or any laws.
You agree not to submit User Content that
is defamatory, hateful, violent, obscene, unlawful, or otherwise objectionable
(as determined by Zebo Ride in its sole discretion), even if such content might
otherwise be legally protected.
Zebo Ride reserves the right (but has no
obligation) to review, monitor, or remove User Content at any time, for any
reason, without notice.
DEVICE AND NETWORK CONNECTIVITY.
Your Responsibilities for Access and Usage
You are responsible for securing the required data network access to use the
Services. If you access or use the Services from a wireless-enabled device,
your mobile carrier’s data and messaging rates and fees may apply, and you will
be responsible for these charges. Additionally, you must obtain and maintain
compatible hardware or devices to access and use the Services, including any
updates. Zebo Ride does not guarantee that the Services—or any part of
them—will work on all hardware or devices. The Services may also experience
malfunctions and delays, which are common with internet and electronic
communications.
4. PAYMENT
By using the Services, you acknowledge
that you may incur charges for the services or goods received from Zebo Ride
and/or a Third-Party Provider ("Charges"). Once you receive these
services or goods, Zebo Ride will process your payment on behalf of the
Third-Party Provider, acting as their limited payment collection agent. This
payment will be treated as if made directly by you to the Third-Party Provider.
All Charges include applicable taxes where required by law.
Zebo Ride reserves the right to charge you
for tolls, fees, service costs, pickup facilities, and other related expenses,
along with any applicable taxes (including GST). Your trip’s starting city, as
per Zebo Ride’s records, will determine applicable rates. Charges are final and
non-refundable unless Zebo Ride decides otherwise. However, you may negotiate
lower Charges directly with the Third-Party Provider at the time of service.
Zebo Ride will review any requests from Third-Party Providers to adjust Charges
for specific services or goods.
Payment is due immediately and will be
processed using your preferred payment method on file. A receipt will be sent
to your email. If your primary payment method fails, Zebo Ride may charge a
secondary method if available. Zebo Ride retains the sole discretion to set,
modify, or remove Charges at any time. Note that prices may surge in
high-demand areas. While Zebo Ride will attempt to notify you of applicable
Charges, you remain responsible for all costs under your account, regardless of
awareness.
Promotional offers, subscriptions, or
discounts may be available to select users, but unless you qualify, these do
not affect your Charges. You may cancel a service request before the
Third-Party Provider arrives, though a cancellation fee may apply. This fee
compensates both the provider and Zebo Ride.
Unless you use taxicab services via the
app, Zebo Ride does not allocate any portion of your payment as a tip.
References to tipping as "voluntary," "not required," or
"included" do not imply additional payments to the provider. While
you may tip at your discretion, it is never mandatory. After receiving
services, you can rate your experience and provide feedback on the Third-Party
Provider.
REPAIR AND CLEANING CHARGES.
Repair
or Cleaning Costs: You
are responsible for covering the costs of repairing damage to, or necessary
cleaning of, Third-Party Provider vehicles and property caused by your use of
the Services under your Account, beyond normal "wear and tear." If a
Third-Party Provider reports the need for Repair or Cleaning, and Zebo Ride
verifies the request in its reasonable judgment, Zebo Ride may charge your
designated payment method to cover the reasonable expenses. These payments will
be forwarded to the Third-Party Provider and are non-refundable.
5. DISCLAIMER CLAUSES; LIABILITY
RESTRICTIONS; INDEMNIFICATION TERMS
DISCLAIMER
The services are offered on
an "as is" and "as available" basis.
Zebo Ride expressly disclaims all warranties—whether express, implied, or
statutory—that are not explicitly stated in these terms, including but not
limited to implied warranties of merchantability, fitness for a particular
purpose, and non-infringement.
Additionally, Zebo Ride does not guarantee
the reliability, timeliness, quality, suitability, or availability of
the services or any goods or services obtained through them. There is no
assurance that the services will be uninterrupted or error-free. Zebo Ride
also makes no representations regarding the quality, suitability, safety,
or capability of third-party providers.
By using the services, you acknowledge and
agree that you assume all risks associated with their use, including
any services or goods accessed through them, to the fullest extent permitted by
law.
LIABILITY DISCLAIMER.
Limitation of
Liability
ZEBO RIDE will not be held responsible for
any indirect, incidental, special, exemplary, punitive, or consequential
damages—including lost profits, lost data, personal injury, or property
damage—arising from or related to the use of its services, even if ZEBO RIDE
has been informed of the potential for such damages.
ZEBO RIDE is not liable for any damages,
liabilities, or losses resulting from:
Your use of, reliance on, or inability to
access or use the services; or
Any interactions or transactions between
you and a third-party provider, even if ZEBO RIDE has been made aware of such
risks.
Additionally, ZEBO RIDE is not responsible
for delays or failures in performance caused by circumstances beyond its reasonable
control.
You acknowledge that some third-party
transportation providers accessed through the platform may offer ridesharing or
peer-to-peer services and may not hold professional licenses or permits.
ZEBO RIDE’s total liability to you for any
claims related to the services is capped at five thousand rupees (₹5,000),
unless prohibited by applicable consumer protection laws.
While you may use ZEBO RIDE’s services to
request transportation, goods, or logistics from third-party providers, ZEBO
RIDE disclaims all responsibility and liability for the actions or services
provided by these third parties, except as explicitly stated in these terms.
Nothing in this section overrides your
statutory rights as a consumer where such limitations are not permitted by law.
INDEMNITY.
You agree to protect and compensate Zebo Ride,
along with its officers, directors, employees, and agents, from any claims,
demands, losses, liabilities, and expenses (including legal fees) related to:
(i) your use of the Services or any goods/services obtained through them;
(ii) your violation of these Terms;
(iii) Zebo Ride’s use of your User Content; or
(iv) your infringement of any third-party rights, including those of
Third-Party Providers.
6. GOVERNING LAW AND ARBITRATION CLAUSE.
Governing Law and Dispute Resolution
Unless otherwise stated in these Terms,
the laws of India shall exclusively govern and interpret these Terms. Any
dispute, conflict, claim, or controversy arising from or related to the
Services or these Terms—including questions regarding their validity,
interpretation, or enforceability (a "Dispute")—must first be
submitted to mandatory mediation under Indian law.
If the Dispute remains unresolved sixty
(60) days after the mediation request is filed, it shall be referred to and
finally settled by arbitration in accordance with the Arbitration and
Conciliation Act, 1996 ("Act"). The arbitration will be
conducted by a single arbitrator appointed under the Act. Both mediation and
arbitration proceedings shall take place in India, and the language
used shall be English. However, if a party does not speak English,
the proceedings may be conducted in both English and that party’s native
language.
All aspects of the mediation and
arbitration—including submissions, correspondence, decisions, and awards—shall
remain strictly confidential unless both parties provide express
written consent for disclosure. Confidentiality may only be waived if:
1.
Disclosure is
reasonably necessary for the proceedings, and
2.
The third party agrees
in writing to uphold this confidentiality obligation.
7. OTHER PROVISIONS
COPYRIGHT INFRINGEMENT
CLAIMS.
Copyright Infringement Claims: Notices of copyright infringement should be
submitted to Zebo Ride’s designated agent.
Notices: Zebo Ride may provide notice through a general announcement on the
Services, via email to the address associated with your Account, or by written
correspondence to the address on file in your Account. You may notify Zebo Ride
in writing by sending correspondence to the address specified above.
General Provisions:
ZEBO
RIDE: POLICIES FOR LAW ENFORCEMENT.
These guidelines are designed to help law
enforcement understand the legal procedures for requesting records from Zebo
Ride. Please note that these are general recommendations only, and the
information provided is subject to change. For requests from private
parties—such as civil litigants or criminal defendants—please refer to
the Guidelines for Third Party Data Requests.
WHAT IS ZEBO RIDE AND RECORDS WE HAVE?
Zebo Ride is a tech company that operates a platform connecting riders with
independent driver partners for transportation services. The company does not
function as a transportation carrier and does not employ drivers directly.
Through the Zebo Ride App, users can request rides via smartphone,
web, or SMS, selecting from available drivers in their area. After each trip,
both the rider and driver partner receive a fare receipt.
For further details about our services,
visit [link]. User data is handled in accordance with our Privacy
Policy, which outline how information is stored and managed.
WHAT
LEGAL PROCEDURES MUST ZEBO RIDE FOLLOW BEFORE DISCLOSING USER OR PARTNER
INFORMATION?
We can only disclose business records related
to partners, users, or trips upon receipt of proper and legally binding
documentation. In most cases, a valid court order or search warrant is required
for us to provide any information. Law enforcement requests may be submitted
via email to support@zeboride.com or
delivered in person to our corporate address: (Company Address).
Accepting legal process does not waive any objections Zebo Ride may have and
reserves the right to assert in response to the request.
WHAT
TYPES OF REQUESTS DOES ZEBO RIDE ACCEPT, AND HOW ARE THEY HANDLED?
To process a request, we require the applicable
procedure (as outlined above) along with a valid return email address from an
official government domain. Each submission is reviewed for both facial and
substantive validity, and we may deny requests that fail to meet these
standards. Specifically, requests must be narrowly tailored to a legitimate law
enforcement purpose—overly broad, vague, or excessively burdensome requests
will not be accepted.
To ensure your Law Enforcement Request is valid and
appropriately scoped, please include:
We only disclose data to law enforcement when legally
obligated to do so. In such cases, we will provide information that is
reasonably accessible and retrievable.
HOW
DOES ZEBO RIDE MANAGE EMERGENCY SITUATIONS?
We have an emergency evaluation process
for urgent situations involving the safety of users, driver partners, or third
parties, or to halt illegal activity that presents an imminent risk of death or
serious physical harm. To submit an emergency request, requestors must complete
an Emergency Request Form (available by contacting support@zeboride.com), providing a detailed explanation of the emergency. Each request is
reviewed individually.
Law enforcement agencies may submit emergency requests by emailing support@zeboride.com. Please note that only law enforcement requests will
be reviewed and addressed—non-law enforcement inquiries sent to this email will
not receive a response.
If you are a non-law enforcement
individual aware of an emergency, please contact local law enforcement immediately.
DOES ZEBO RIDE INFORM USERS WHEN LAW ENFORCEMENT
REQUESTS THEIR INFORMATION?
Yes, we may inform individuals before sharing
their information with law enforcement, unless legal restrictions prevent us
from doing so or in urgent situations like emergencies. If law enforcement
officials determine that notification could compromise an investigation, they
should secure a valid court order or legal process to formally prohibit such
notice.
CAN ZEBO RIDE PROVIDE AN AUTHENTICATION
CERTIFICATE OR EXPERT TESTIMONY?
We can
supply a certification from our records custodian but typically cannot offer
in-person or expert witness testimony. Law enforcement officials with inquiries
regarding these guidelines should contact us at support@zeboride.com.
Please be advised that this email address is only for law enforcement requests;
non-law enforcement inquiries will not receive a response. For all other
requests, please refer to our Guidelines for Third-Party Data Requests.
